Terms of Service – Starter Builds
General Terms and Purpose of this Agreement
We (Forward Web) will always do our best to fulfill your needs and meet your goals, but sometimes it is best to have a written statement/terms so both parties can have a full understanding of what is expected (from a vendor and consumer stand point). We have done our best to keep the context of our terms of service as simple as possible, however should you have any questions, do not hesitate to ask.
Agreement
As our customer, you have the power and ability to enter into this contract on behalf of your company or organization. You agree to provide us with everything that we need to complete the project including text, images and other information as and when we need it, and in the format that we ask for. You agree to review our work in a timely manner, along with provide necessary feedback so we may complete your project in a timely manner.
Legal
We can’t guarantee that the functions contained in any web page templates or in a completed web site will always be error-free and so we can’t be liable to you or any third party for damages, including lost profits, lost savings or other incidental, consequential or special damages arising out of the operation of or inability to operate this web site and any other web pages, even if you have advised us of the possibilities of such damages.
If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions
Scope of Work:
With this service you are enlisting Forward Web to build your website using WordPress (content management system) via Pre-Made templates. Although you will get the option to choose your template; ultimately, we are building your website using a pre-made template that will initially be limited to the amount of customization’s we will be able to make to your initial website build.
If at any point during the development process you would like to use the expertise and skill to customize your WordPress theme. We will be more than happy to do so, however additional fees or depending on the level of customization being requested, a separate agreement may be required.
Price and Plan Changes: Although we will always do our best to avoid changes to your prices or service. Sometimes this might be necessary. In the case that changes are necessary, Forward Web makes the commitment to notify you at least 30 days prior to your renewal date to inform you of any impending changes to your service or pricing.
Cancellation Policy: You agree to give Forward Web at least 7 days’ notice prior to your renewal period, otherwise you will be responsible for payment of the renewal (regardless of whether you intend to keep your website or not). Although we will always do our best to send renewal reminders to the email on file, ultimately it is your responsibility to ensure you cancel your service if you do not intend to continue.
Refund Policy: Aside from any domain name fees, you are eligible for a full refund up until the point a template is approved. Once you have approved your template for content insertion, you are committed for the first year at which no part of your service fee is refundable, no pro-rated refunds, no exceptions.
Privacy Policy: Forward Web will never sell or re-distribute your contact information or content without your prior written consent. This includes, but is not limited to phone numbers, email, IP’s or browser cookies (or any other method used to track your website visitor activity.
Copyrights/Licensing: You guarantee (to the best of your knowledge) any elements of text, graphics, photos, designs, trademarks, or other artwork that you provide us for inclusion in the web site are either owned by you or your company, or that you have permission to use them (downloading images from google and sending them to us is not ok, purchasing images from Istock/Getty and then sending them to us is ok.
Likewise, any themes, plugins or photos used on your website are not to be redistributed, re-sold or Trademarked without the consent of the photographer or theme developer. Doing so could result in a copyright violation in which Forward Web will not be liable for any copyright issues that arise from re-distribution of media or Trademark attempts.
Transfer of Website: Assuming your fees are paid and your account is in good standing, you can pack-up your website and move your website to any web hosting company of your choosing. However, in doing so, you understand that you would in effect be canceling your service with Forward Web.
Web Hosting: You agree to adhere and follow our shared web hosting terms of service at all times, a violation of our shared web hosting terms of service can lead to a suspension of your website. Warranty: As part of our warranty should any situation occur where your website theme is compromised or a plugin that we installed stops working. We will fix, patch your website at no additional cost. However, if at anytime you install your own theme, or plugin, or attempt to make updates to plugins or core theme files, this warranty becomes null and void. Although you will always have full control over your website. In order to maintain the warranty of this website, we highly recommend running the addition of plugins, replacement of themes or core updates (or anything that might alter or change the general functionality of your website) through Forward Web first.
